The Trump administration has invoked a rarely used provision of the 1930 Tariff Act to impose 50% surtaxes on a broad range of Canadian goods, a measure affecting nearly $20 billion in annual imports.

U.S. President Donald Trump invoked Section 338 of the Tariff Act of 1930 on July 20 to impose additional 50% tariffs on certain Canadian goods, set to take effect August 19, 2026. The tariffs cover a wide range of products, including dairy, alcoholic beverages, electronics, building materials, apparel and certain agricultural goods.

According to a release from the Office of the U.S. Trade Representative, the measure affects nearly $20 billion in annual imports from Canada. The tariffs apply to all covered goods regardless of whether they qualify under the Canada–United States–Mexico Agreement (CUSMA/USMCA), but exclude energy, potash, goods already subject to Section 232 tariffs, and certain items such as fish and critical minerals.

Washington is framing the move as a response to what it calls discriminatory treatment of U.S. exports in the dairy, alcoholic beverage and automotive sectors. The Canadian government has not yet announced formal retaliatory measures following the announcement.

Canadian exporters in the affected sectors have just over two weeks before the new tariffs take effect to adjust supply chains or pricing.
